The “Belaire” term describes an “opt-out” notice that is sent to potential class members to inform them of the lawsuit

 On January 6, 2016 a “Belaire Notice” was sent out to Assistant Store Managers who have worked in California for Wal-mart Associates, Inc. The class action lawsuit was originally filed by the San Francisco employment attorneys at Blumenthal, Nordrehaug, & Bhowmik on January 29, 2015.

The lawsuit alleged that Wal-Mart Associates, Inc. misclassified their Assistant Store Managers and as a result the company allegedly failed to pay these employees overtime wages. The Wal-Mart Associates, Inc. class action, Case No. is currently pending in the Alameda County Superior Court for the State of California, Case No. RG15756555 .
