Norman Blumenthal Discusses The California Supreme Court’s Obligation To Narrowly Construe All Exemptions To California’s Labor Laws

On Wednesday, May 29, 2013, Los Angeles employment lawyer Norman Blumenthal authored an article in the Los Angeles Daily Journal, where he discussed, among other things, the current state of employees’ rights in California.

According to the article written by Norman Blumenthal, “California’s Department of Labor, due to budgetary constraints, does not have the resources to police and prosecute wage-and-hour violations. To nevertheless allow for prosecution of violators, the Legislature passed the Private Attorney General Act (PAGA), which allows private attorney generals deputized by the state to prosecute these claims.” Mr. Blumenthal claims that a contract waiver of the right of the state to police wage-and-hour violations is contrary to California labor laws. Mr. Blumenthal further states in the article that, “if our [State] Supreme Court in Iskanian denies the executive branch the right to enforce PAGA laws, employers will no longer fear prosecution for wage-and-hour violations.”
