Furthermore, the complaint alleges that Gallagher Bassett Services, failed to provide mandatory meal and rest breaks to its employees. The class action complaint alleges that Gallagher Bassett Services failed to accurately pay all required overtime compensation for work performed by the PLAINTIFF and other Claims Adjusters and therefore, allegedly violated the California Labor Code. Cal. Lab. Code § 510 further provides that employees in California shall not be employed more than eight (8) hours per workday and/or more than forty (40) hours per workweek unless they receive additional compensation beyond their regular wages in amounts specified by law.
According to the class action complaint, the company’s non-exempt employees were also allegedly unable to take off duty meal breaks due as required by the applicable Wage Order and Labor Code. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee’s fifth (5th) hour of work. The complaint alleges that the company did not provide their employees who forfeited meal breaks additional compensation.
