Georgia Bar seeks emergency suspension of Albany lawyer – Albany Herald

The State Bar of Georgia has petitioned for the emergency suspension of attorney Joseph Durham Jr. of Albany. Filed September 12, the petition alleges Durham violated multiple Georgia Rules of Professional Conduct, and that his behavior presents a substantial risk of harm to both his clients and the public.

At issue is Durham’s handling of client settlement funds. He is accused of using money meant for one client to satisfy obligations for another, paying his own debts, or using it for personal/business expenses without disclosing this to his clients. In particular, in the Shannon Payne case, Durham allegedly received a $1.5 million settlement, but diverted much of those funds away from Payne.

Another case involves a wrongful-death lawsuit representing the Reids (Kiwanis Reid, Tony Reid Jr., Monquavious Reid, Dominique Reid), where he allegedly misled them about the settlement amount (telling them $650,000 when it was actually $625,000). There are claims he promised Dominique Reid’s funds would be placed in a structured settlement, but the vehicle used (Strategic Wealth Planners LLC) was not a structured settlement company, and the funds were instead misdirected.

Other allegations include bounced checks to clients, falsified documents, making false statements to the Bar, failing to respond to record requests, misusing clients’ funds through business entities like Strategic Wealth Planners LLC and Esquire Legal Funding LLC, and making frivolous legal filings meant to harass individuals.

Durham has seven disciplinary matters pending before a Special Master. The Bar is seeking a hearing before the Special Master to determine whether Durham should be suspended immediately while those matters are resolved. Durham’s attorneys have responded by saying the allegations are “grossly inaccurate,” and that they will present evidence to refute them.
